Terms and Conditions

The Website IndianPersonnel.com (hereinafter refered to as "IndianPersonnel™" ) provides recruitment services ("Services") pursuant to the terms and conditions set forth below. By Registering, you will be deemed to have agreed to use the Services in a manner consistent with the terms and conditions stated below and with all applicable laws and regulations.

Modification of Terms of Service

IndianPersonnel reserves the right to edit, alter, modify or change these terms and conditions without any prior notice. Users of the website are deemed to have read and accepted the same whenever they use the website.

Subscriber Conduct

You agree you are solely responsible for your content and you acknowledge IndianPersonnel™ acts as a passive conduit for the distribution and transmission of your data. You represent and warrant that the content you provide to IndianPersonnel™ :

(a) does not infringe on any third party's intellectual property or proprietary rights or rights of privacy;

(b) does not violate any law, statute, ordinance or regulation;

(c) is not defamatory, trade libellous, pornographic or obscene; or

(d) does not contain viruses or other similar harmful or deleterious programming routines.

If you violate this provision IndianPersonnel™ reserves the right to take such action as it may deem fit including termination of your rights to use the Service and all other remedies available to IndianPersonnel™ by law.


Registration Data

In consideration for the Service, you agree to provide IndianPersonnel™ current, complete, and accurate registration information (the "Information ") as prompted and to maintain and update this Information such that it is current, complete and accurate. You grant IndianPersonnel™ the right to disclose the aggregate Information to third parties in connection with marketing the Services. Furthermore, IndianPersonnel™ may itself use your individual Registration Data to provide the targeting of advertisements and other Service offers.

Privacy

Except as provided above, IndianPersonnel™ will not intentionally monitor or disclose any private message or address Information unless required by law, regulation or court order. You agree to respect the privacy and confidentiality of others users of the website.

Personal Use & Security

You agree not to resell or make any commercial use of the Service without the express consent of IndianPersonnel™ You are entirely responsible for not maintaining the confidentiality of your password and account. You shall be fully liable for all use of the Service, including any unauthorized use of your account by any third party.

Indemnification

You agree to defend, indemnify and hold harmless IndianPersonnel™, its employees, directors, officers, agents and their successors and assigns from and against any and all liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of your account, including any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.

Term

This Agreement shall continue in full force and effect for so long as you are using the Services. Either you or IndianPersonnel™ may terminate the service at any time, with or without cause by expressly informing the other of the same. All provisions of this agreement which by their nature survive termination shall survive termination.

Disclaimer of Warranties

You expressly agree that the use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. IndianPersonnel™ expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. IndianPersonnel™ makes no warranty that the Services will meet your requirements, or that the Services will be uninterrupted, timely, secure, or error free. Nor does IndianPersonnel™ make any warranty as to the results that may be obtained through the Service or that defects in the software will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk and you will be soley responsible for any damage to your computer systems or loss of data that results from the download of such material and/or data. IndianPersonnel™ makes no warranty regarding any goods or services purchased or obtained through the Service or any transaction entered into through the Service. No advice or information, whether oral or written, which you obtain through the Service shall create any warranty not expressly made herein.

Limitation of Liability

IndianPersonnel™ shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of, or in connection with this agreement, even if IndianPersonnel™ has been advised of the possibility of damages.

Proprietary Rights to Content

The Website design, text, graphics (including buttons icons and images but excluding those graphics to which third Parties retain copyright ownership) the selection and arrangement thereof, and all IndianPersonnel's software are Copyright © IndianPersonnel Services Pvt. Ltd.


IndianPersonnel.com™ and all other trademarks and tradenames appearing on IndianPersonnel are the property of IndianPersonnel.com Pvt. Ltd. IndianPersonnel's trademarks, logos, service marks, and tradenames may not be used in connection with any product or service that is not provided by IndianPersonnel or in any manner that is likely to cause confusion, or in any manner that disparages or discredits IndianPersonnel Systems Pvt. Ltd. or IndianPersonnel. All other trademarks or service marks, brand names, company names and/or logos appearing on IndianPersonnel are property of their respective owners.

Miscellaneous
This agreement will be governed by and construed in accordance with the laws of India without giving effect to principles of conflict of laws. The Courts at Mumbai shall have exclusive jurisdiction in respect of any proceedings arising out of this Agreement. Any provision of this Agreement being held to be invalid or unenforceable, shall not in any way affect the validity, legality or enforceability of the remainder of this Agreement. IndianPersonnel's failure or delay to act with respect to the enforcement of the obligations and covenants under this Agreement does not waive its right to act with respect to subsequent or similar obligations or covenants under this Agreement. All rights and remedies existing under this Agreement except as otherwise provided herein are cumulative to, and not exclusive of any rights or remedies otherwise available. This Agreement sets forth the entire understanding and agreement between you and IndianPersonnel.
